LA PERMANENTE TRANSITORIEDAD PATRIMONIAL DEL VALLE DE CUELGAMUROS (VALLE DE LOS CAÍDOS) Y SU TRASCENDENCIA EN LA PROTECCIÓN COMO PATRIMONIO HISTÓRICO
Siendo la transitoriedad la cualidad de lo pasajero, resulta sorprendente la indeterminación que a día de hoy sigue arrastrando el régimen jurídico patrimonial del Valle de Cuelgamuros, anteriormente denominado Valle de los Caídos. Podremos comprobar, a lo largo de las presentes líneas, cómo el legislador ha ido demorando de manera indefinida la definición de su régimen jurídico, sembrando inopinadamente dudas sobre su titularidad y naturaleza jurídica.
No se trata de una cuestión puramente dialéctica, en cuanto podría ser determinante para dirimir la competencia estatal o autonómica para su protección como patrimonio histórico. Entreveremos los requisitos legalmente establecidos para discernir esa competencia y ahondaremos en el devenir normativo por el que ha transitado el estatus patrimonial del conocido monumento.

This is not a purely dialectical issue, as it could be decisive in resolving state or regional jurisdiction for its protection as historical heritage. We will glimpse the legally established requirements to discern this competence and we will delve into the regulatory evolution through which the heritage status of the well-known monument has passed.
