La reciente sentencia aborda un conflicto cada vez más frecuente en el panorama audiovisual: la tensión entre la libertad de creación artística y los derechos al honor e intimidad cuando una ficción se inspira en personas reales. El Tribunal Supremo profundiza en la distinción entre el derecho a la creación literaria del artículo 20.1.b CE y la libertad de expresión, consolidando la doctrina sobre obras “basadas en hechos reales”. La sentencia establece criterios claros sobre recognoscibilidad, necesidad narrativa y proporcionalidad de la intromisión en la esfera privada. Este trabajo analiza la resolución en el contexto de la jurisprudencia reciente del Tribunal Supremo (SSTS 5352/2024 y 3/2025) y del Tribunal Constitucional (STC 1/2025), mostrando la evolución hacia un estándar más preciso que protege la creación artística sin desproteger la dignidad personal.
The recent judgment addresses an increasingly common conflict in audiovisual production: the tension between artistic freedom and the rights to honor and privacy when fiction is inspired by real people. The Supreme Court delves into the distinction between the right to literary creation under Article 20.1.b of the Spanish Constitution and freedom of expression, consolidating the doctrine on works “based on real events.” The ruling establishes clear criteria regarding recognizability, narrative necessity, and proportionality of intrusion into private life. This paper analyzes the decision in the context of recent Supreme Court case law (SSTS 5352/2024 and 3/2025) and the Constitutional Court (STC 1/2025), showing the evolution towards a more precise standard that protects artistic creation without leaving personal dignity unprotected.
